Service Description

Nettingale provides managed WordPress hosting services including server infrastructure, storage, backups, SSL certificates, and CDN. By using our service, you agree to these terms.

Our handling of your personal data is described in our Privacy Policy.

Account Responsibilities

  • You are responsible for maintaining the security of your account credentials
  • You must provide accurate account information
  • You are responsible for all content hosted on your WordPress sites
  • One account per person; sharing accounts is not permitted

Age Requirement

You must be at least 16 years old to use Nettingale. By creating an account, you confirm that you meet this age requirement.

Acceptable Use

You agree not to use our service for:

  • Illegal activities or content
  • Malware distribution or phishing
  • Spam or bulk unsolicited communications
  • Activities that harm our infrastructure or other users
  • Circumventing resource limits or security measures

Copyright and Takedown Requests

If you believe content hosted on Nettingale infringes your copyright or other intellectual property rights, you may submit a takedown request to moc.elagnitten@esuba. Your request must include:

  • The URL(s) of the allegedly infringing content
  • A description of the copyrighted work
  • Proof of ownership or authorization to act on behalf of the owner
  • Your contact information

We will review the request, notify the site owner, and may disable access to the content pending resolution. The site owner may submit a counter-notice if they believe the takedown was made in error. Abuse of the takedown process may result in account restrictions.

Intellectual Property

You retain full ownership of all content you create or upload to your WordPress sites hosted on Nettingale.

Nettingale retains ownership of the platform, brand, software, and infrastructure. Nothing in these terms grants you rights to our intellectual property beyond what is necessary to use the service.

Resource Limits

Each plan includes specific storage and bandwidth limits. Exceeding these limits may result in service restrictions. We will notify you before taking action where possible.

Payment Terms

  • Subscriptions are billed annually or monthly, depending on the plan
  • Prices are in Euros
  • Renewals are automatic unless cancelled
  • 30-day money-back guarantee for new subscriptions

Cancellation and Data Export

You may cancel your subscription at any time from your dashboard. Upon cancellation:

  • Your service continues until the end of the billing period
  • You have 30 days after the service ends to export your data
  • Export is available via SFTP and database dump in standard WordPress format (files + SQL)
  • No refunds for partial periods (except within the 30-day guarantee)

Service Availability

We target 99.9% uptime for our hosting services, excluding scheduled maintenance. Scheduled maintenance is announced at least 24 hours in advance when possible.

We are not liable for downtime caused by factors outside our control, including natural disasters, war, government action, pandemic, widespread internet outages, or failures of third-party infrastructure providers (force majeure).

Backups

We provide automated daily backups with 30-day retention. While we make every effort to maintain reliable backups, you are ultimately responsible for maintaining your own copies of critical data.

Abuse Reports and Suspension

Third parties may report abuse (such as phishing, malware, or spam) hosted on our platform by contacting moc.elagnitten@esuba. Upon receiving a report:

  • We investigate and may suspend the site immediately for serious violations (malware, phishing)
  • The site owner is notified with the reason for suspension and an appeal process
  • Repeated violations lead to account termination

Termination

We may suspend or terminate your account if you:

  • Violate these terms or our acceptable use policy
  • Fail to pay for your subscription
  • Engage in fraudulent activity

We will provide notice before termination where possible, except in cases of serious violations.

Limitation of Liability

Our liability is limited to the amount you paid for the service in the 12 months preceding any claim. We are not liable for indirect, incidental, or consequential damages.

Changes to Terms

We may update these terms. Material changes will be communicated via email at least 30 days before taking effect. Continued use of the service constitutes acceptance of updated terms.

Governing Law

These terms are governed by the laws of Bulgaria. Disputes will be resolved in the courts of Bulgaria.
